Rep. Anna Paulina Luna (R-FL) wants the release of the audio recordings of former special counsel Robert Hur's interview with President Joe Biden amid suspicion that the transcript was "doctored."

Luna appeared on Sunday Morning Futures to provide an update on the fight to retrieve these tapes from the Department of Justice. Biden’s competence was called into question by Hur, who referred to the president as “an elderly man with a poor memory.” Hur’s office interviewed Biden last year but found he did not have a “mental state of willfulness” and, therefore, was not worth charging over his handling of classified documents because “it would be difficult to convince a jury that they should convict him.” While their interview transcript was released, Luna wants the tapes to be released to the public to paint a full picture of Biden's competence.

"I believe that it's possible that [the transcript's] been doctored, but I also think, Maria, that it’s really going to show the American people whether or not Biden is actually capable of making those decisions," Luna said. "Remember, we have a foreign-policy debacle right now. We have Russian warships off of our coast, and if he is not able to stand fit as president , I don’t think that he's going to be the nominee this November. I think that’s why Democrats are trying to protect him and the DOJ."

"So you don’t think he's going to be the nominee?" host Maria Bartiromo asked.

"Not if these tapes come out, no, Maria," Luna said. "I think that they have big problems, and I think his cognitive inability is the number one issue for them currently."

The Democratic National Convention is slated to begin on Aug. 19, when the party's nominee will become official. In March, Biden had received enough primary votes to reach the majority threshold.

CNN, the Heritage Foundation, and Judicial Watch, among others, have all been denied Freedom of Information Act requests for the audio and have subsequently filed suit against the Justice Department. The Department of Justice claims it is withholding the audio due to fears that it will be altered by artificial intelligence, according to a court filing .

Hur left his position as special counsel with the department in March. Just before he resigned, he addressed the House Judiciary Committee about his interview. This committee and the House Oversight Committee have since issued subpoenas for the audio, which have also gone unanswered.
