MARSHALL COUNTY, W.Va. ( WTRF ) – West Virginia man, Koleton Caruso, 23, of Marshall County was sentenced in Judge Jeffery Cramer’s circuit court Monday morning.

Caruso plead guilty to crimes dating back to February 2024 , where he crashed head on into a deputy cruiser causing injuries.

Judge Cramer sentenced Caruso to the following:

    • Count 3 Felony: Fleeing with Wreckless Indifference
      • Sentenced to 1-5 years in State Correctional Facility and a $1000 fine
    • Count 6 Felony: Destruction of Property
      • Sentenced to 1 to 10 years in State Correctional Facility
    • Count 4 Misdemeanor: Battery on an Officer
      • Sentenced to 12 months in jail
    • Count 7 Misdemeanor: Driving while Under the Influence
      • Sentenced to 6 months in jail and a $500 fine

These sentences will run consecutively and will start once Caruso is done serving a one-to-10-year sentence from a previous crime.

According to Joe Canestraro, Caruso will “be in prison custody for three to 25 years.”

Canestraro says Caruso could be released on parole for good behavior after serving three years in prison but would still serve at least one year in jail for the two misdemeanor charges (battery on an officer and the DUI.)

“Again, with good behavior, he could be done serving his jail sentence in 6 months,” Canestraro said.

Judge Cramer said during the sentencing that he would permit Caruso’s attorney to submit a motion to modify the imposed sentence “at some point.”

Caruso is facing criminal charges in two other West Virginia counties, Ohio and Brooke, and in the state of Ohio.

Before making a ruling on a sentence modification, Judge Cramer commented during Monday’s sentencing that he would like to see what happens in the other pending court cases.
