    Are fireworks legal in NC? Here's what to know about state laws on pyrotechnics

    For Independence Day, many North Carolina residents may be wondering about what types of fireworks can be discharged at barbecues and Fourth of July parties across the state.

    It's probably obvious that there are some variations in N.C. fireworks laws. While you can see some impressive pyrotechnics at concerts, parades and other Independence Day celebrations , you could also be sentenced to months in prison for setting off a Roman candle in your backyard.

    Here's what to know about what types of fireworks you're free to use during your celebration this year , laws on aerial pyrotechnics, age restrictions and more.

    What types of fireworks are legal in NC?

    Unlike our more lenient neighbors in South Carolina, N.C. law prohibits setting off any fireworks that leave the ground, including smaller pyrotechnics like Roman candles and bottle rockets. Novelty items like sparklers, however, are perfectly lawful. Fully legal pyrotechnics in N.C. include the following:

    • Exploding caps used in toy pistols
    • Pressed pellets that create "snakes" of ash when burned
    • Smoke devices
    • Snappers
    • String poppers
    • Party poppers
    • Wire sparklers
    • Other sparkling fireworks that meet N.C. standards

    Other fireworks including bottle rockets, Roman candles, mortars and anything that explodes and/or can be projected into the air are illegal — even if purchased in another state and transported to N.C.

    Can you get a fireworks permit in NC?

    Though there are many restrictions on buying, selling and discharging fireworks in N.C., there are some notable exceptions to the rules. Aerial fireworks can be used at events such as concerts by operators who have completed proper training and licensing. The operator must also have written authority from the city or board of county commissioners in the county where the fireworks are being used.

    What is the penalty for illegal fireworks in NC?

    According to N.C. legislation, violating N.C. firework laws generally results in a Class 2 misdemeanor. If the illegal fireworks were used indoors, this is upgraded to a more serious charge of a Class 1 misdemeanor.

    If you're found in possession of pyrotechnics without the correct permissions, this possession can be used as evidence against you in court. Punishment may include fines of up to $500, and imprisonment of up to six months.

    Age restrictions on fireworks in NC

    Selling fireworks to a person under 16 years of age is illegal in N.C. This means that children under the age of 16 can't legally buy or use fireworks in the state.
