    Judge denies temporary restraining order from JCPS parents' busing changes lawsuit

    A federal judge denied the request of several parents of Jefferson County Public School students for a temporary restraining order regarding the school district's transportation plan, according to court documents.

    District Judge Rebecca Grady Jennings denied the request because the parents, the defendants in the case, did not give the school district or Superintendent Marty Pollio, who are both named in the lawsuit, a copy of documents including the original complaint and the Motion for Temporary Restraining Order, documents show.

    Not sending the documents is only permitted under the law if the lawyer proves in writing that they tried to give the other party the documents or why it would not be required and if the danger to the suing party is too much that it cannot wait for the defendants to respond.

    Parents of JCPS students sued the school district over the April decision that cut busing for the majority of magnet students. According to the original complaint, two of the students will be forced to go to Valley Station and Martin Luther King Elementary School if busing is not provided.

    Both facilities, the suit argues, are some of the district's "worst schools."

    "The action of the Defendants will intentionally cause high schools in lower socio-economic neighborhoods to become overcrowded, continued havens for violence, and cause abysmal educational outcomes to become even worse," court documents state.

    The judge said the parents have until Monday to clarify certain details, including how they have tried notifying the district, court documents state.

    On Wednesday, proof of notification of the lawsuit sent to Pollio and the school district on June 20 was filed in the court system. The judge has not yet made any further determinations in the case.
