WICHITA, Kan. (KSNW) — The owner of the Marion County Record says court documents appear to clear the newspaper of wrongdoing.

Officers raided the newspaper’s offices and the home of the publisher , Eric Meyer, on Aug. 11, 2023. They seized equipment and personal cell phones. Gideon Cody, who was police chief then, said he was investigating whether the newspaper committed identity theft or other crimes in accessing a local restaurant owner’s state driving record.

The Kansas Bureau of Investigation and the Colorado Bureau of Investigation have been looking into any potentially illegal acts by the officers or others. A CBI spokesperson told KSN he anticipates the report will be completed soon.

In the meantime, Meyer wrote in the newspaper this week that evidence has been made available through the discovery process for the lawsuit he’s filed against the City of Marion, law enforcement, and local officials.

Meyer says court documents point to an email from a KBI agent to the general counsel for the Kansas Department of Revenue asking, “Is it a violation of the law for someone to access another’s Kansas driver’s license information via the state KDOR public website?”

According to Meyer, the department’s counsel responded, “No.”

During the police raid at the Meyer home, 98-year-old Joan Meyer became visibly upset at the officers . Her son, Eric Meyer, said officers were warned she might die from the stress. She died 24 hours later.

Sedgwick County District Attorney Marc Bennett has been assigned as a special prosecutor in the case. In May, he said he would not comment until the investigation was complete.
