    Trial scheduled for man accused of killing Port Huron teacher in crash

    A man accused of being intoxicated and causing a crash that killed a Port Huron teacher is heading to trial.

    No plea agreement was reached Monday, and Justin Simon's is set to go on trial Sept. 10.

    Simon, 45, was charged with operating a vehicle while intoxicated causing death after he was reportedly involved in a crash on Lakeshore Road that resulted in the death of Ashley Nisbett, a teacher at Port Huron Northern High School.

    The St. Clair County Prosecutor's Office has said several open alcohol containers were found inside his vehicle after the crash.

    Nisbett was hospitalized at McLaren Macomb after the crash. She died four days later. Simon's attorneys were granted access to her medical records

    The two parties told Circuit Court Judge Daniel Damman there was no plea deal to discuss. Simon could still choose to plead guilty in the future, but he would not be allowed to plea to a reduced charge as part of the agreement.

    Simon is also filing a motion to adjust his bond so he can legally leave the state while awaiting trial.

    The St. Clair County Sheriff's Office identified him as a resident from Tennessee who was visiting Michigan to hunt at the time of the crash.

    No court date has been set to hear Simon's motion. Operating a vehicle while intoxicated causing death is punishable by up to 15 years in prison if convicted.
