Passenger killed after drunk driver crashes into second story of San Jose residence

( KRON ) — A man was killed early Saturday morning after the vehicle he was riding in veered off the road and crashed into the second story of a residence, according to the San Jose Police Department. The woman who was driving was allegedly intoxicated, police said.

SJPD officers responded to the area of McKee Road and Francis Drive just before 2:30 a.m. on a report of a solo vehicle crash. A preliminary investigation revealed that a red 2022 Subaru sedan was being driven by a woman at a high rate of speed when the driver lost control. The vehicle went over the center median and across all eastbound lanes, leaving the roadway on the south curb of McKee Road.

The vehicle careened through a fence and crashed into the second story of the residence. The residence was evacuated and no residents were injured, police said.

The driver was taken to the hospital with non-life-threatening injuries. The passenger was pronounced dead at the scene. The driver was taken into custody at the hospital on charges of gross vehicular manslaughter while intoxicated.

KRON4 spoke with a man who lives at the home with his father and aunt. He said his father was sleeping in the room that the car crashed into but was uninjured.

Crashes are common on this stretch of McKee Road, the family said. In April, a man died in a crash on the same section of McKee.

The identity of the victim will be released by the Santa Clara County Coroner’s Office, police said. The incident marked San Jose’s 23rd fatal crash and 23rd traffic death of 2024.
