Gwenn Homan, 47, of Kansas, was sentenced on July 9 for her role in the theft of a Budget Rental truck.
On July 8, Homan entered a plea agreement where her original charge of theft by receiving stolen property, a class IIA felony, was amended to attempted theft by receiving stolen property, a class IIIA felony.
As part of her sentencing, Homan was sentenced to 60 days in county jail, receiving credit for the 44 days already spent in jail at the time of her sentencing. Homan will also have to spend 18 months on probation as well as pay court fees.
Homan was originally arrested on May 25 when her and Brian Church were spotted in the stolen Budget Rental truck in South Sioux City. She was arrested after a pursuit with police that happened after Church drove the vehicle at a police officer. The officer fired a shot at the truck, and when they were finally stopped by officials near Elk Point, it was revealed that Church had been hit by the bullet.
Church pleaded not guilty to theft by receiving stolen property, a class IIA felony, operation of a motor vehicle to avoid arrest, and attempted assault on an officer using a motor vehicle, both class IV felonies. Church is scheduled to appear in court for a pretrial conference on August 20 at 9 a.m.
