These parties have collectively agreed on the terms of a proposed settlement with attorneys representing individual and class plaintiffs affected by the fires. Under the proposed terms, the defendants will collectively pay over $4 billion to resolve all tort claims stemming from the August 8, 2023, windstorms and wildfires on Maui. Specifically, HEI and Hawaiian Electric’s contribution amounts to $1.99 billion (pre-tax), which includes a previously contributed $75 million for the One Ohana Initiative. This initiative was an initial step toward addressing the immediate needs of those affected by the fires.

    It is important to note that the proposed settlement does not include any admission of liability by the defendants.     Kimura also stressed that while the settlement will close one chapter in the recovery process, the journey toward rebuilding and creating a resilient future for Lahaina and Maui will continue for many years.     The Mediation Process

    The settlement terms were reached after an extensive four-month mediation process between the defendants and attorneys representing plaintiffs from Lahaina and Upcountry Maui. This period of negotiation was crucial in arriving at a mutually agreeable solution that addresses the needs of the affected parties while enabling the defendants to reestablish financial stability. Currently, the proposed settlement is an agreement in principle, contingent on resolving claims from insurance companies that have already paid out for property loss and other damages. Importantly, no additional payments from defendants are expected to resolve these claims.

    Before the settlement can take effect, it must undergo judicial review and receive court approval. Once a final settlement agreement is signed and approved by the court, the payment process will begin. The first payments are expected to be made no earlier than mid-2025.
