    Polk sheriff says 3 people were selling pot out of a bus, claiming 'No medical card required'

    The Polk County Sheriff's Office said three people were selling marijuana out of a bus at a shopping center in Northeast Polk marketed as a "Cannabis Mobile Dispensary," emblazoned with marijuana leaves and signs claiming "No Medical Card Required."

    In a news release Friday, the Sheriff's Office said deputies received a complaint on Wednesday about the bus operating at a shopping center off U.S. 192 in the Clermont area of unincorporated Polk County.

    Deputies saw the Eldorado bus decorated with multiple marijuana leaves and an exterior advertisement claiming that no medical marijuana card was required to buy marijuana within. The Sheriff's Office said there was a sign inside the bus that said: “No medical card? No problem! Use ours! For $5."

    "Medical marijuana is legal in the State of Florida , but the recreational use of marijuana is illegal," the Sheriff's Office said in the release. "FSS 381.986 requires that individuals obtain a physician’s recommendation, then register with the state to obtain a medical card before one is allowed to legally purchase the product from state-licensed dispensaries."

    Using another person's card to purchase marijuana is illegal.

    The Sheriff's Office said detectives found online advertisements for the business that called their operation "FL's 1st Recreational Dispensary."

    Jimmy Andrial, 40, and his wife, Bianca, 35, told detectives they bought the marijuana unpackaged using Jimmy's card from a licensed supplier and then packaged the marijuana for sale themselves, according to the Sheriff's Office. The release said the Andrials do not have a state-issued license to sell marijuana, and they refused to tell detectives where they purchased it.

    During a search of the bus, detectives found multiple containers of marijuana, drug paraphernalia, a digital scale with cocaine residue, vape cartridges and packaging materials, the release said. Twelve packages of marijuana were found, each labeled 3.5 grams, bringing the total amount well over the 20-gram threshold for a felony, PCSO said.

    Jimmy and Bianca Andrial were arrested, as was an employee, Daniel McCreary, 37.

    The Sheriff's Offfice said McCreary became physical and resisted arrest and Jimmy Andrial threatened the detectives during his arrest and stated that he had been to prison four times.

    McCreary faces charges of resisting arrest, possession of marijuana with intent to sell, possession of drug paraphernalia, possession of marijuana over 20 grams, keeping a vehicle for drug sales and possession of cocaine.

    The Sheriff's Office said it is still investigating the online portion of the CMD business, as well as the suppliers of both the marijuana and the packaging materials.
