Florida in Shock as DeSantis Leans on Immunity Against Disney

Florida Governor Ron DeSantis is entering another chapter of his shocking war on Disney.

He's repeatedly declared victory over Disney, only to encounter twists and turns on every major step. If nothing, this seems to be good PR for the governor.

Once again, the Florida governor "welcomes Disney's surrender" on significant claims in the company's political reprisal lawsuit.

DeSantis refuses to follow the same rules

DeSantis is drafting legislation to target the media and entertainment giant as retaliation for the company's opposition to the divisive "Don't Say Gay" classroom law.

In a recent court filing, the lawyers representing DeSantis and another Florida official argued that because the governor's alleged actions are "legislative in nature," they are shielded by "absolute legislative immunity." Florida Governor seeks protection no matter the rules, positioning himself as someone above the law of everyday Americans.

The court document was filed before Disney reported mixed earnings for the third quarter of its fiscal year.

The state's attorneys asserted that Disney confessed in a document made last month that most of its initial case was little more than "a glorified press release."

According to DeSantis's lawyers, Disney "now claims that it is challenging only the Governor's executive actions," not his legislative activities.

Filing in the U.S. District Court in Tallahassee is merely the most recent jab in a protracted spat between Florida's governor and one of the major employers in the state.

It was a reaction to Disney's prior filing of pleading urging the judge to deny DeSantis and other defendants' requests to dismiss the federal civil case.

In the filing, Disney argued that DeSantis' assertions of legal immunity are "incorrect."

"Because this suit seeks to enjoin the Governor from performing executive acts, legislative immunity does not protect him from suit," Disney's spokesperson said.

Disney requested a court order to restore the status quo before DeSantis and his allies targeted the special tax district that has long allowed Walt Disney World in Orlando to operate independently.

Do you think DeSantis should be immune against the Disney lawsuit?
