    Owners of medical equipment company acquitted in fraud scheme trial

    SAN ANTONIO, Texas ( ValleyCentral ) — Two men who were indicted on federal charges in connection to a $14.5 million health care fraud scheme, have been found not guilty by a jury.

    In 2023, Kuba Zarobkiewicz, of San Antonio, and Anthony Fermin, of Boca Raton, Florida, were charged with 22 counts related to health care fraud, identity theft and kickbacks, according to the U.S. Attorney’s Office.

    Farrukh Mirza, of Richmond, Texas, was also part of the original indictment and charged with four counts of receipt of illegal health care kickbacks.

    Zarobkiewicz and Fermin went to trial to prove that they did not own various medical equipment companies and pharmacies involved in a scheme to defraud Medicare. Their alleged role in the scheme was to pay kickbacks to telemarketing firms owned and operated by Mirza in exchange for signed doctor’s orders issued for unnecessary hip, knee and back braces, federal prosecutors allege.

    Federal records show that both Karokiewicz and Fermin were found not guilty on multiple charges.

    The two were found not guilty by the jury of conspiracy to pay and receive health care kickbacks, four counts of offer and payment of illegal health care kickbacks and aiding and abetting, conspiracy to commit health care fraud, and five counts of health care fraud aiding and abetting.

    Federal records indicate Mirza will be sentenced for his role in the crime Nov. 13 in San Antonio.
