    Third competency hearing granted for man accused of blinding security guard in attack

    DAYTON, Ohio ( WDTN ) — The attorneys for the man accused of violently attacking and disabling a security guard are petitioning for a third competency hearing.

    At a hearing Thursday, the judge granted that motion for James Fickling which will be paid for by his attorneys.

    Fickling is accused of attacking a security guard on North Main Street in Dayton last October , gouging out both of her eyes and leaving her blind.

    Fickling has pleaded not guilty by reason of insanity to several charges including assault. He’s already been ruled competent to stand trial twice .

    The judge granted the third hearing but ordered Fickling’s attorneys to pay for it. Results are expected back in six weeks.

    If Fickling is found competent after this latest evaluation, his trial is set to begin in December.
