    Man accused of causing DUI crash says sober driver ‘should have been more alert’

    CHARLESTON, S.C. (WCBD) — A man who police said caused a crash while driving under the influence on Monday in a South Carolina city said the sober driver “should have been more alert.”

    Charleston police found two overturned vehicles at an intersection in West Ashley after responding to the area for a crash.

    Rey David Garcia Hernandez, 24, allegedly admitted to EMS that he had consumed five beers at a restaurant, police said. He was taken to a hospital for treatment.

    While there, he told officers that the other driver ran a red light and crashed into him, according to the report. However, police noted that there is no traffic light at the intersection where the crash happened. Instead, police said Hernandez ignored a stop sign in the area.

    During the investigation, police said that Hernandez admitted to consuming five Cerveza Victorias and said he was “not that drunk” because it takes 10 to 15 beers to make him “too messed up to drive,” according to the report.

    Police said the man repeatedly admitted to being drunk while he was questioned about the crash. He claimed the accident was not his fault because he was “drunk,” but that the other driver should have been more alert because he was not “drunk” and could have avoided the crash.

    In another comment, Hernandez stated that he was “not that drunk” and that he felt fine after five beers, police said. He then said he was driving drunk, but that it was OK because he used to drive drunk in Mexico.

    After agreeing to a field sobriety test, Hernandez was arrested for driving under the influence and taken to jail. He was released the next day.
