TERRE HAUTE, Ind. (WTWO/WAWV)— A Terre Haute Firefighter remains in the department after entering into a pre-trial diversion in Clay County.

According to court documents, Sam Nathan Switzer was charged on June 20, 2024, with Battery resulting in bodily injury, a level 6 felony. The court documents state the victim was under the age of 14.

In August, Switzer entered into the pre-trial diversion. According to a statement from Michael Wright, Terre Haute City Attorney, the pre-trial diversion “means there has been no finding by a court related to his guilt or innocence.”

According to court documents, as a part of the pre-trial diversion, Switzer had to pay fees totaling $454 and for the next 365 days he must obey all local, state, and federal laws, and must answer all reasonable inquiries from the Clay County Prosecutor’s Office. He must also submit and pay for anger management counseling. It is stated in court documents that if he fulfills all of the requirements the case will be dismissed. However, if he does not, the agreement will be revoked and a trial date will be set.

Wright noted that Switzer is still a merit officer with the Terre Haute Fire Department.

“The city is continuing to monitor the situation/agreement and if circumstances change, the City reserves the right to ask again for the Merit Board to get involved.” Wright wrote in his statement.
