Miguel Ocana, 40, was given a summons for discharging a firearm within city limits, a first-degree misdemeanor. He is expected to be arraigned Friday in municipal court.

Reports said police were called about 8 p.m. to the 200 block of Gaither Avenue for a gunshot sensor call and as they were there witnesses told them a man at a nearby home in the 400 block of Emery Avenue had been firing a gun into the air.

As police were checking the neighborhood reports said Ocana came out of his home and fired several shots into the air from a handgun. When his magazine was empty and he went inside, police moved into the house and ordered Ocana outside.

Ocana came out with his hands up and told police he was firing his gun into the air to celebrate the Fourth of July holiday and that other people were also doing it.

Reports said police collected 22 9mm shell casings in a nearby backyard.
