11 ways you can get a DUI in Kentucky without being behind the wheel

KENTUCKY ( FOX 56 ) — Did you know that driving a car while intoxicated isn’t the only way to land a DUI charge in Kentucky?

According to Kentucky law, operating anything while under the influence could land you behind bars. KRS 189.520 states that a blood alcohol level of .08 or higher is grounds for a DUI, even if the “vehicle” is non-motorized.

“No person under the influence of intoxicating beverages or any substance which may impair one’s driving ability shall operate a vehicle that is not a motor vehicle anywhere in this state,” the law reads.

Intoxalock, an ignition interlock or in-vehicle breathalyzer supplier, compiled a list of 11 surprising ways you can get a DUI. Per Kentucky law, all of the following apply in the Commonwealth.

1. Riding a bike
2. Riding a horse or driving a horse-drawn vehicle
3. Driving a golf cart
4. Boating
5. On a lawn mower
6. Operating a segway
7. Riding a moped
8. Operating a tractor or other farm equipment
9. Operating an electric vehicle
10. Operating a snowmobile
11. Driving a battery-powered child’s toy car, such as a Power Wheels

That’s right, riding your child’s Power Wheels Barbie Jeep under the influence could cost you a DUI.

“Thanks to several folks testing this one out, we now know that children’s toy cars can still get you a DUI, especially if you have a 6-pack in the back. Since these toys have a battery, they technically have power steering, which means they’ll be prosecuted as a motor vehicle,” Intoxalock said.

The only way to avoid a DUI, is to have a designated driver, according to Intoxalock.
