    New Mexico Supreme Court rules on parental rights for same-sex couples

    NEW MEXICO (KRQE) –  Same-sex couples in New Mexico who get divorced have new rules when it comes to custody battle over their children. The New Mexico Supreme Court ruled that legal custody should be in the best interest of the child.

    The court used a case from 2017 where Jeannine Kammann was denied the title of legal parent because her children did not share her genes. Her ex-wife gave birth to their children through artificial insemination while they were married.

    The justice ruled in favor of Kammann and said she is a legal parent regardless of DNA.
