    Jackson charged with second-degree possession

    Duane Isack Jackson, 53, Little Falls, was charged in Morrison County District Court with one felony count of second-degree possession of a controlled substance, one felony count of fifth-degree possession of a controlled substance and one gross misdemeanor count of third-degree DWI.

    The charges stem from an Aug. 5 incident, at approximately 7:59 p.m., when a deputy of the Morrison County Sheriff’s Office received a traffic complaint in Bowlus. The reporting party gave a description of the vehicle, stating it drove through a stop sign, according to the report.

    The deputy responded to the report and located the suspect vehicle in a ditch on 40th Street near the intersection of Main Street. Per the report, there was a male subject standing outside of the vehicle. The deputy recognized the suspect as Jackson.

    According to the report, Jackson stated he did not know how his vehicle got into the ditch. Jackson had red, bloodshot and watery eyes. Jackson allegedly admitted that he used drugs approximately two days earlier. The deputy asked Jackson to perform field sobriety tests. On the modified Romberg test, Jackson estimated the passage of 30 seconds in 32 seconds. Jackson had an elevated pulse rate of 102 beats per minute, which is above the average range. On the horizontal gaze nystagmus test, Jackson displayed no nystagmus, but he had difficulty maintaining focus during the test. Jackson performed poorly on the walk and turn test and the one leg stand test. Jackson was then placed under arrest for driving while impaired.

    Jackson was searched incident to arrest. The deputy located a meth pipe in Jackson’s pocket. Inside the same pocket was a satchel containing a substance that later field tested positive for methamphetamine and weighed 5.4 grams with packaging. Also inside the satchel was a substance that field tested positive for heroin and weighed 10.2 grams with packaging, according to the report.

    Jackson was transported to a hospital where the deputy applied for a search warrant for a blood or urine sample. The search warrant was approved by a district court judge. Jackson agreed to submit to a blood test. A blood sample was taken at 9:43 p.m. and was sent to the BCA for testing.

    An examination of Jackson’s driving record showed a DWI-related license revocation from April.

    If convicted on the second-degree felony possession charge, Jackson faces no less than three years and up to 40 years imprisonment and/or a $500,000 fine. If convicted on the fifth-degree felony possession charge, Jackson faces up to five years imprisonment and/or a $10,000 fine
