    Tempe to update rules allowing 'casitas' on residential property

    Tempe is set to update its zoning code regulations for accessory dwelling units following the May passage of a bill requiring municipalities to do so.

    The Arizona Legislature passed House Bill 2720 that requires cities with populations of 75,000 or more to adopt new regulations by January 2025 to permit ADUs — often referred to as casitas — on all lots where single-family dwellings are allowed.

    ADUs, smaller rentable units on the same lot as a single-family home, have been allowed in Tempe since 2019, but these coming updates will expand ADU eligibility and incorporate state requirements, a city release stated.

    Prior to the passage of HB 2720, Tempe City Council had directed city staff to begin researching a potential update to the city’s ADU regulations, according to the release. Since the passage of the bill, the city has adapted its proposal to meet state requirements.

    Timeline and next steps

    The community can offer feedback at upcoming public hearings: the Development Review Commission meeting at 6 p.m. Aug. 27 and city council’s first and second hearings on Oct. 1 and Nov. 21.

    City staff began initial research for potential updates to ADU regulations in late 2023, according to the release.

    Since then, the city has held six public meetings and two online surveys to gather input. Results were presented at the June 20 council work study session, noting the adoption of HB 2720.
