Unprofessional, rude, and disgusting: those are just some of the words to describe the behavior of State Supreme Court Justice Erin Gal who has captured national attention. She now faces possible removal from the bench after threatening a group of Black teenagers at a house party near Utica in the summer of 2022. Police bodycam footage of the event was recently released to the public.
So what the heck happened? Well, The altercation began at a high school graduation party hosted by a friend of the judge, where tensions escalated between invited and uninvited guests. A group of Black teenagers, who had received a text invitation to the party, found themselves at the center of a confrontation that led to a fight and ultimately resulted in the loss of their car keys, leaving them stranded in the neighborhood. Now, in a shocking but not so shocking display of power and privilege, Judge Gall, “allegedly” resorted to threats of gun violence against the teenagers, invoking her judicial authority in an attempt to force them off the property. In video footage released by law enforcement, Gall can be heard making derogatory remarks about the teenagers’ intelligence and expressing a willingness to use force to remove them from the premises.
“Get off the property, and that’s from Judge Gall, I’m a freaking judge and I’m telling you get off the freaking property. Listen, I’m a supreme court judge,” Gall can be seen and heard telling the teens in the footage. “I’ll shoot them on the property. If I have to clean it out I will,” Gall also says. To make matters worse, The video also captures her making comments about the Black teens’ intelligence levels while praising her son for allegedly beating up partygoers. “They don’t look like they’re that smart. They’re not going to business school that’s for sure,” Gall said about the Black teens.
The New York State Commission on Judicial Conduct has since called for Gall’s removal from the bench in light of her troubling behavior, citing a clear abuse of power and racial insensitivity.
“It is utterly unacceptable for a judge to threaten gun violence, exhibit racial prejudice, promise favorable treatment for the police, or disparage a law intended to keep guns away from dangerous people,” Commission Administrator Robert Tembeckjian said in a statement to the press. “Any one of these things would undermine public confidence in the administration of justice.”
However, Gall’s defense attorney has argued that the judge’s actions were influenced by a previous trauma and that she was not in the right state of mind at the time of the incident. “I was acting as a mom who just witnessed something awful. I wasn’t acting appropriately or thinking the right way,” Gall said in part.
Apparently, she sought counseling following the incident.
She has since been suspended with pay… her salary is $232,600 a year… The fate of Gall now rests in the hands of the Court of Appeal.
