    Restraining order issued in legal fight over water services at Buc-ee’s

    DAYTON, Ohio ( WDTN ) — The Huber Heights Buc-ee’s is caught in the middle of a legal battle.

    A Judge granted Clark County’s request for a temporary restraining order against the city of Huber Heights. This comes after the county’s board of commissioners filed a lawsuit over a dispute related to water and sewer services in the area where Buc-ee’s will be located.

    Court documents show Huber Heights plans to pump sanitary flow from Centerpoint 70 to the Fairborn Water Treatment Plant rather than the Clark County pump station. The city also plans to separate its water main at the west end of Centerpoint 70 Boulevard into two different systems.

    The Board of Clark County Commissioners claim that two agreements (made in 1988 and 1995) give the county exclusive jurisdiction in regards to water and sewer services from Centerpoint 70.

    Commissioners requested the restraining order to put a pause on the changes while the two jurisdictions work out the dispute.

    City leaders say this will not affect Buc-ee’s construction, which broke ground last week .

    A trial to dispute rights over water and sewer services in the area is scheduled for Oct. 21.
