DAPHNE, Ala. ( WKRG ) — A Daphne man was arrested Saturday morning after police received an unpleasant 911 call from his apartment.

“There was nobody talking directly to the dispatcher, but the dispatcher could hear that there was yelling in the background,” Daphne Police Chief Brian Gulsby said.

Prosecutors said police were dispatched to the home of 31-year-old Cody Macon where they found a female victim covered in blood claiming Macon beat her up and threatened to hurt their 3-year-old child.

Police said due to the threats Macon made against the child, they forced entry to the home and found Macon with the child.

“The defendant was actually in a bedroom and then held the 3-year-old up between himself and the officers when they came up, using him as a shield,” Gulsby said.

Police said they were able to get the child away safely and detain Macon; however, Macon wasn’t ready to give up the fight.

“When they got him outside, he started threatening to kill everybody,” Gulsby said. “He spit on two of the officers. He spit on two fire medics.”

Macon was arrested and charged with second-degree domestic violence, reckless endangerment of a child, possession of a pistol by a violent felon, two counts of assault of a police officer, three counts of assault with bodily fluids, resisting arrest and second-degree making a terrorist threat.

Daphne Police said Macon has been arrested seven different times in three states for domestic violence and was on parole when Saturday’s incident happened in Daphne.
