The Lubbock Police Department previously said officers were called to the 3600 block of 42nd Street around 3:00 a.m. for a domestic disturbance. Jacob Munoz, 35, was found with serious injuries. He was taken to University Medical Center, where he later passed away.

Court records stated Jeremy told detectives that an argument with his brother led to a physical fight inside the home. Jeremy said his brother put him in a chokehold, so he grabbed a metal pole. After a family member told Jacob to let go of Jeremy, the two went outside the residence.

“Jeremy had the opportunity to walk away from the altercation but did not,” court documents stated.
