2 failure-to-move-over stops lead to drug charges in Fredericksburg

Fredericksburg officers had the Move Over Law top of mind last week. On two consecutive days, cases of drivers allegedly failing to move over ended with drug charges.

Wednesday stop

The first incident occurred on Wednesday, August 21. Officer Velasco was providing backup for a traffic stop in the 1800 block of Emancipation Highway and a vehicle came by that failed to move over and failed to slow down, according to FPD.

Velasco was cleared and went after vehicle that passed. When he made the stop, FPD said Officer Hibbitts arrived at the scene to assist.

The two officers saw “drug items in plain view,” FPD reported.

Velasco searched the driver, 26-year-old Kyle Hill of Spotsylvania. Meanwhile, Hibbitts was attempting to identify the female passenger who “repeatedly provided the officer with a false name and date of birth,” FPD stated.

Velasco realized he had dealt with the female on another call and they were able to identify her as 25-year-old Skylar McFadden, also of Spotsylvania. She was wanted in Stafford for failure to appear on a drug charge, FPD also noted.

FPD said a search of the vehicle revealed narcotics and ammunition.

Hill was charged with possession of a schedule I/II drug, possession of ammunition by a felon, no driver's license, and failing to move over for an emergency vehicle.

McFadden is charged with identity theft and false ID to avoid arrest.

Both were granted a $2,000 bond.

Hill has been released. McFadden is still in Rappahannock Regional Jail.

Thursday stop

The following day, it was Hibbitts who was providing backup on a call on Fall Hill Ave.

According to FPD, once again, a vehicle passed without moving over or slowing down. Hibbitts went after the vehicle and made the stop on Roffman Road.

Officer Murphy and K9 Raider arrived on the scene to assist. K9 Raider gave an indication for drugs in the vehicle. FPD said the search led to the discovery of digital scales, drug packaging materials, fentanyl pills, and a loaded firearm.

Bryan Frye, a 57-year-old Fredericksburg man, was arrested and charged with possession with intent to distribute a schedule I/II drug, possession of a firearm while possessing a schedule I/II drug, possession of a firearm as a convicted felon, possession of ammunition as a convicted felon, and failure to move over for emergency vehicles.

Frye was granted a $3,000 bond. Jail records show he has been released.
